Scott R. McMillen started his legal career representing hospitals and doctors, but for over 30 years he has been exclusively representing patients in medical malpractice cases. Mr. McMillen received his B.S. Degree from Florida State University and a Doctor of Law degree from Emory University. He has been licensed to practice law in Florida since 1980, and in Georgia since 1979. He became Senior Counsel to Paul Knopf Bigger in December 2020.
Mr. McMillen has been involved in many professional organizations in Florida, including serving on The Florida Bar Board of Governors for six years, and on the Board of Directors of the Florida Justice Association, where he has previously served as Chair of the Medical Malpractice Committee. He is a past President of The Central Florida Trial Lawyers, past President of the Orange County Bar Association, and past President of the Orange County Bar Legal Aid Society.
Mr. McMillen is a member of the Georgia Trial Lawyers Association and has served on the Georgia Bar Board of Governors and the Georgia Bar’s Professionalism Committee.

For over 20 years Mr. McMillen authored the monthly medical malpractice law column in the Journal of the Florida Justice Association, which is distributed to attorneys statewide. Together with his attorney daughter, Allison C. McMillen, he co-authored a section in the Florida Bar’s Medical Malpractice Handbook, 2 nd Edition, regarding the Florida Birth-Related Neurological Injury Compensation Plan in the Florida Medical Malpractice Handbook. Other important malpractice publications by Mr. McMillen include “The Overlooked Emergency Room Cause of Action” Vol. LXXI, No. 10 The Florida Bar Journal (Nov. 1997), and “The Medical Malpractice Statute of Limitations” Vol. LXX, No. 2 The Florida Bar Journal (Feb. 1996).

U.S. News & World Report has recognized Mr. McMillen as one of the “Best Lawyers in America,” and he has been named a “Super Lawyer” by Thomson Reuters. He has also been rated as “AV- Preeminent” by Martindale-Hubbell, and “Superb – 10 out of 10” by AVVO. Florida Trend Magazine has named him to their list of lawyers considered to be the “Legal Elite.” Scott was named Best Lawyers’ Best Medical Malpractice Litigation Lawyer for Plaintiffs in Orlando for 2025 and 2022.
